What does no win no fee mean for serious injury claims?

No win no fee, formally as a Conditional Fee Agreement, or CFA, is a type of funding between yourself and your solicitor. You begin your claim with no fee to pay. If your claim is unsuccessful, you pay nothing. Thompsons absorbs the cost.

That protection holds more importance for serious injury claims than it does for a simple whiplash claim. Claims over brain injuries, spinal cord damage, loss of limbs or death are some of the most complex types of personal injury. They can take years rather than months, require specialist medical evidence and are likely to involve rehabilitation programmes, interim payments and ongoing care evaluations.

All of this can be handled under our no win no fee agreement. The length and complexity of your claim will not affect the money you put in up front, which is none.

How no win no fee works for serious injuries

Thompsons' No Win No Fee package allows you to proceed with a claim and have access to leading personal injury lawyers, whatever your financial circumstances. The process includes:

  1. Free initial assessment: Contact Thompsons and we discuss your case at no cost. We will tell you honestly whether we think you have a claim worth pursuing.
  2. Conditional Fee Agreement signed : If we believe your claim has merit, we formalise the arrangement in writing. This sets out the terms, including the percentage we would charge if you win.
  3. Your claim is pursued: Our solicitors handle the investigation, gather medical evidence, instruct specialists and negotiate on your behalf. You concentrate on your recovery.
  4. Outcome: If your claim succeeds, you receive compensation. If it does not, you pay nothing.

When Thompsons takes on your claim under our No Win No Fee arrangement, there is nothing to pay at the outset. If the claim is unsuccessful, you walk away without having to pay a penny for our services.

What does no win no fee cost if you win?

If you win, you will pay a set percentage of your compensation to Thompsons. We try to make this as small as possible, and in most cases it will not be more than 20% of your compensation. Some firms take a lot more and we have heard of cases where claimants have been charged up to 40% for straightforward claims. We believe in justice and want you to receive the justice you deserve. With this in mind, we are dedicated to transparency.

Below is a cost breakdown:

  • Success fee: A percentage agreed at the start of your case. At Thompsons, this is not above 20% in most cases. The law caps the success fee at 20% of your general damages, meaning the compensation for pain, suffering and loss of amenity. Your financial losses such as lost earnings, care costs, medical expenses, and adaptations to your home, are protected from the success fee entirely.
  • After the event (ATE) insurance: A policy taken out after your accident to protect you if the claim fails. The premium is only payable if you win, at which point it comes from your compensation. If you lose, you owe nothing.
  • Disbursements: The out-of-pocket costs of running a claim: medical reports, court fees, expert witness fees. In most successful claims, these are recovered from the other side.

What happens if you lose your serious injury claim?

Claims for serious accidents can sometimes be lengthy and complicated. With our No Win No Fee package, we cover the costs of running your whole case, whether the case settles after weeks, months or years, you pay nothing until the end. If you lose, you pay nothing at all: every single fee and expense Thompsons has incurred on your behalf is included in the package.

The ATE insurance policy we arrange as part of the agreement covers the other side's legal costs if your claim is unsuccessful. There are no hidden costs, and no nasty surprises waiting at the end.

There is a legal cap from your general damages — the compensation you receive for pain, suffering and loss of amenity. It cannot apply towards your financial losses such as lost earnings, care costs or medical bills. At Thompsons, our charges are not above 20% in most cases, which is below what a number of other firms charge.

None. No payments are due in advance and nothing is payable if the claim is unsuccessful. If successful, the costs are limited to the pre-agreed success fee, the ATE insurance premium where applicable, and any disbursements not recovered from the other side. We explain all of this before you sign anything.

That depends on the case. A less complicated claim could resolve within a matter of months. Serious and catastrophic injury claims can take longer, sometimes several years, because they require detailed medical evidence, rehabilitation assessments and a thorough understanding of how the injury will affect the rest of your life. The duration of the case does not change what you pay upfront under our no win no fee arrangement.

In Scotland, the usual time limit is three years from the date of the accident or from the date on which you first became aware of the injury. Different rules apply to claims involving children or adults who lack mental capacity. We would always advise getting in touch at the earliest opportunity as evidence is easier to obtain when it is fresh, and a missed deadline can mean losing the right to claim altogether.
