The Role

Key Responsibilities

As a solicitor within our Union Accident Team, your primary focus will be to provide legal support and representation for individuals who have experienced workplace accidents or other personal injury. The position will require the management of a diverse caseload, and you will be responsible for overseeing all aspects of the claims process from initial investigation to resolution. Specific responsibilities include:

  • Case Management: You will manage your own caseload of Employer Liability, Public Liability, Occupiers' Liability, and Criminal Injuries Compensation Authority cases. This involves conducting comprehensive case assessments, developing strategies for successful outcomes, and ensuring that each case is progressed efficiently and effectively.
  • Pre-Litigation and Litigation: You will be expected to handle a mix of pre-litigated and litigated files, working both independently and collaboratively with other members of the team. This includes preparing cases for litigation, advising clients on the strengths and weaknesses of their claims, and negotiating settlements where appropriate.
  • Court Work: You will be responsible for dealing with cases in the All-Scotland Personal Injury Court (ASPIC), Court of Session, and Sheriff Courts. This includes drafting key court documents such as writs and motions, and making court appearances on behalf of clients. You will also work closely with Counsel to prepare for complex cases and represent clients in hearings.
  • Client Engagement: A key part of your role will involve building strong relationships with clients. You will be responsible for taking detailed witness statements, explaining the legal process in a clear and understandable way, and ensuring that clients are kept informed throughout the duration of their case.
  • Liability Investigations: You will carry out thorough investigations into the circumstances of each case, collecting and reviewing evidence to establish liability. This will involve interviewing witnesses, gathering documentary evidence, and working with expert investigators and other professionals to build a strong case for your client.
  • Medical Experts: In cases involving personal injury, you will be required to instruct and consult with medical experts to obtain reports that support your client’s claim. This includes coordinating with medical professionals, reviewing their findings, and incorporating these reports into the overall legal strategy. 

Requirements

  • To be considered for this role, you must have:
  • A minimum of 3 years PQE.
  • Experience in handling Employer Liability, Public Liability, and Occupiers' Liability cases.
  • The ability to commute to one of our Scottish offices.
