A quarry company based in Aberdeen have been fined almost £100,000 following the death of one of their workers in November 2008.

Leiths (Scotland), who operate at Parkmore Quarry in Dufftown were fined £96,000 at Elgin Sheriff Court after being pleading guilty to breaching section 2(1) of the Health and Safety at Work etc Act 1974.

Arthur Jamieson, 58, of Aultmore, near Keith, sustained fatal crush injuries when the digger he was working under rolled back and crushed him. He suffocated as a result of the wheel of the five-and-a-half tonne machine compressing his chest. The digger had been on a ramp but was not adequately secured.

The court heard how Mr Jamieson was fixing a transmission leak and had been given no direction or assistance in the task he was undertaking. Although he was an experienced mobile plant fitter, he had not carried out this task for the firm before.

A Health and Safety Executive inspector stated the death should have been  preventable, and that Mr Jamieson should have received training and supervision for the job, which was not provided. The Inspector said: “Had Mr Jamieson been adequately supervised, he would not have been able to start working underneath the digger when it was inadequately secured at the rear and therefore able to move from its position on the ramps. As a result his death could have been prevented.”
