In the recent case of Hunter v Niemiec in Glasgow Sheriff Court, Hunter claimed compensation from the driver of a car that crashed into the rear of his van.
The claimant, a self-employed delivery driver suffered whiplash injuries and losses that lasted approximately six months due to the car accident. The claimant was a keen sportsman playing golf four or five times a week having a handicap of 6, football twice a week and tennis once a week, unfortunately as a result of his personal injuries he was unable to play his sports for months following the accident.
The Sheriff accepted that the claimant had pursued his sports to a very high degree and in the case of golf to a very high standard and was unable to participate in these sports for a period of time due to his personal injuries, therefore awarding compensation in the sum of £3,000.
The Sheriff took the view that the car accident had more of an impact on the claimant than it would have with a person with a more sedentary lifestyle.
