Accident injury lawyers Thompsons has secured compensation for a woman involved in a head on collision with a cow. Jane Boylan was travelling along the A72 Biggar to Peebles road late at night when her vehicle suddenly and without warning struck a cow in the middle of the road.
The cow was one of six belonging to a nearby farm which had escaped and wandered onto the road. Ms Boylan suffered extensive injuries including severe damage to her mouth and teeth and her car was damaged beyond repair.
The cattle had escaped from a shed at Lochurd farm, West Linton on the night of the accident in February 2009. The animals were black and therefore almost impossible to see on the unlit road. The cow which caused the collision was fatally injured in the accident.
Award winning personal injury solicitors Thompsons acted for Ms Boylan to recover damages based on her suffering and loss as a result of the accident. She was successfully compensated for her injuries, the loss of her vehicle and for costs in relation to dental treatment and physiotherapy. Commenting on the accident Jane Boylan said: “This has been a particularly upsetting experience as not only have I had to deal with the recovery from my physical injuries but the psychological impact of the nature of the accident. It was a huge shock to be driving along quite happily one moment and the next to have struck an unknown object with such force. It has been difficult to deal with this shock so it was a huge relief to be able to trust Thompsons to take care of all the legal issues and make sure I fully recovered my damages.”
Thompsons partner Derek McLean added: “This was an interesting case in terms of proving liability but we were confident Jane Boylan was an entirely innocent party and had suffered as a result of the defenders’ negligence in failing to ensure that the cows were kept in a secure place well away from a public road. I’m delighted we were able to bring the case to a satisfactory conclusion.”
