In the recent case of Teviotdale v Norwich Union Insurance Ltd, involving a road traffic accident Norwich Union Insurance company were ordered by a Sheriff to pay compensation to Mrs Teviotdale and were ordered to pay Mrs Teviotdale’s Solicitors more legal expenses than would normally be expected.
The insurance company were ordered to pay higher legal expenses because the Sheriff felt the insurance company and their solicitors ought to have known that there was a strong possibility their case would fail, yet they refused enter into negotiations to make an award of compensation to Mrs Teviotdale.
The Sheriff felt that the insurers had not acted reasonably by refusing to negotiate an award of compensation for Mrs Teviotdale and felt the insurers had caused Mrs Tevoitdale to incur greater expense than was necessary.
Mrs Teviotdale was awarded compensation for her loses and her Solicitors were awarded more legal expenses than would normally be expected.
The insurers appealed against the Sheriffs decision however, their appeal was unsuccessful.
