Despite criticising the No Win No Fee culture for the past few years and accusing the culture of increasing the cost of medical negligence cases it appears that the NHS are now using this type of funding to their advantage.

In England and Wales, the NHS Counter Fraud Service has reached an agreement with a law firm on a No Win No Fee type basis to recoup money lost to fraud.

Approximately half of the medical negligence cases that the NHS deal with are funded with a No Win No Fee agreement, where the lawyers only get paid if they win the case.  The NHS have strongly criticised these types of agreement in the past and are therefore now being accused of double standards.
