A Ross-shire woman who had aspirations to become a model, was left in a wheelchair when her footballer boyfriend, John Catto caused a road traffic accident after he crashed the car she was travelling as a passenger in on the Black Isle in March 2006.

Road Traffic Accident Injury Compensation ClaimsJohn Catto, a footballer with Ross County, was alleged to have been racing Steven Skinner a former apprentice at the club on the A832 Avoch to Munlochy near Roskill at the time of the road traffic accident. It was alleged that they had been racing each other, driving at speeds of 80 to 90mph on narrow roads when Catto lost control of his car causing it to leave the road. Miss Davis, suffered severe spinal injuries causing her to lose the use of her legs, a broken pelvis, head injuries and major chest trauma including a collapsed lung.

Following the road traffic accident, both Catto and Skinner were prosecuted with Catto receiving a 30 month driving ban and 220 hours community service with Skinner receiving a ban of 12 months and a fine totalling £750.

Miss Davis raised a court action for £3,000,000 against both drivers. At a hearing in the Court of Session this week, both representatives for Skinner and Catto argued over the extent to which either party were liable for her personal injuries. After hearing four days of evidence, Colin Macaulay QC sitting as a temporary judge at the Court of Session concluded that the pair were not racing each other but had been driving grossly in excess of the speed limit. The judge concluded that Mr Catto was 80% to blame and that Mr Skinner was due 20% of any compensation claim payment together with expenses claimed by Miss Davis.
