A pedestrian who was hurt in a road traffic accident is to be awarded compensation from a Council who failed to trim some bushes on a central reservation.

The lady from Dalston in North London was struck by a taxi whilst attempting to cross the road.  At the time of the accident the traffic lights were not in her favour.  At the first court hearing she was held to be at fault for the road traffic accident.

However the Court of Appeal found that the bushes in the central reservation had obscured her view of the traffic.  The three judges were all in agreement that despite the pedestrian’s own negligence, the council still owed her a duty of care.  They held that they failed in that duty as they had failed to trim the bushes.

The pedestrian was held to be 75% to blame for the accident which means that the Council require to pay her 25% of the compensation that is due to her.  The amount of compensation payable will be assessed at a later date.

As a result of the road traffic accident she suffered life threatening personal injuries, including internal injuries and a fracture to her neck.
