A 40 year old man, who wishes to remain anonymous, was awarded compensation following an accident at work where he sustained multiple fractures to his leg. The accident happened when a load on a trolley which he was moving became unbalanced and fell on top of him. After the accident he required surgery and has not been able to return to work since. He now also suffers from depression as a result of the accident at work.
The accident happened because the load which he was moving exceeded the weight limit for the trolley, and the road surface which he was moving the trolley on was uneven. In addition to this, the process of moving the load had not been subject to a proper risk assessment. Due to these factors, he made the decision to make a compensation claim.
In court his claim for compensation was successful, as by failing to assess the risks involved in moving the load, his employer was in breach of the Manual Handling Operations Regulations 1992. This led to him receiving a compensation payout of over £100,000.
