Residents in Middlesex have won a legal case against Thames Water Utilities Limited in relation to odour nuisance. The residence pursued a claim on a no win no fee basis.
A Judge at the High Court recently found in favour of the residents. The residents who suffered due to odour being omitted and mosquitoes sought compensation. The residents also sought an injunction to stop such nuisance in the future.
The Judge in his decision held that Thames Water failed to carry out the work and conduct the operation at the sewage plant with reasonable regard and care for the interests of others. He found that Thames Water Utilities Limited were liable for breaches in their duties.
Claimant Steve Taylor is reported as noting that due to the financial clout of Thames Water the case could only be progressed because of the no win no fee system. He stated that changing the no win no fee system will put others off brining cases against big companies and will be an obstacle for ordinary people to access justice.
