A mother has at last won the right to compensation after her son was struck 11 times by another child with a car jack.

A claim was made to the Criminal Injuries Compensation Authority in light of the attack but the CICA refused to pay compensation twice as it disputed that a three year old boy could be guilty of a crime of violence.

However after a hearing, the Tribunals Service has ruled in favour of the boy’s mother and ruled that the CICA must award the full amount that the child is entitled to.

The fight for compensation has been a long and difficult one for the family involved given that the incident happened in December 2007.

Before compensation is awarded, the child will be subject to psychological testing to see how the incident has affected him.
