The tenant of a rented property raised court action against his landlord after he sustained injuries to his hand. The tenant placed his hand on a glass panel of an internal door and the panel broke. The tenant sustained injury to his hand in the accident and pursed a claim for compensation for his injuries.

The tenant felt the glass panel was not thick enough to conform to British Standards and the house was not fit for human habitation.

The tenant was not awarded any compensation, as the Judge did not feel that he was a credible and reliable witness and did not believe that the accident happened in the way in which he described.

The Judge did comment however, that had he believed the tenant’s version of events an award of compensation would have been made.
