A woman who was left wheelchair-bound after being thrown from a fairground ride in May 2006 has been awarded £35,000 personal injury compensation at Wolverhampton Magistrates Court.

Jessica Oseland, 28, from Bilston near Wolverhampton, was thrown from the ride and travelled 45 ft through the air when the carriage that she was riding in became free from the rest of the machine structure. She has been left wheelchair bound. She received severe spinal injuries and has since had to move to specially adapted accommodation. A friend who went on the ride with her, Alison Foxall, sustained head, neck and back injuries but was released from hospital shortly after the accident.

The prosecution for the Health and Safety Executive carried out an inspection of the ride following the accident and found cracks in the welds of 13 out of the 17 carriages.

The owner of the ride was fined £15,000 and ordered to pay £5000 court costs. Another company, Fairground Inspection Services, who had a duty to inspect the ride and ensure it complied with health and safety standards, will pay the personal injury compensation to Miss Oseland. They admitted breaching the Health and Safety at Work etc. Act 1974.

Miss Oseland is pursuing separate civil claims for compensation for her injuries arising from the accident, and if successful may receive several million pounds in compensation.
