Thompsons Scotland recently secured a £35,000 settlement for a Unite member who sustained significant injuries in a workplace accident at Rosyth Royal Dockyard. The case was expertly handled by our specialist solicitor, Nathalie Axelsson, who ensured that the client received the compensation they deserved.

Incident Details:

The client, employed by Babcock as a storeman, was performing his duties on 23rd January 2019 when the accident occurred. He was standing outside Bay 24 of the Rosyth Royal Dockyard, waiting for the gate to open to receive a delivery. A colleague was inside a forklift truck ready to collect the delivery, while another colleague was acting as a banksman.

Without warning, as the right-hand side of the gate opened, the forklift truck driver drove forward, causing the rear wheel of the forklift to catch the client’s right foot. The impact resulted in a fractured metatarsal, a cuboid fracture, and twisting injuries to his calf and thigh. Additionally, the client developed chronic post-traumatic pain and an adjustment disorder.

Legal Process:

Thompsons Scotland pursued the case under vicarious liability and common law. Babcock, the employer, admitted liability for the incident, acknowledging the negligence of their employee in operating the forklift truck.

Settlement:

After thorough negotiations, a settlement of £35,000 was agreed upon to compensate the client for his injuries, pain, and suffering.

Nathalie Axelsson, the solicitor who handled the case, commented, “Our client suffered significant physical and psychological trauma as a result of this avoidable accident. We were committed to ensuring that he received fair compensation for his injuries and the impact on his life. This settlement reflects the seriousness of the injuries, and the negligence involved.”

Conclusion:

This case underscores Thompsons Scotland’s dedication to standing up for the rights of injured workers.
