Thompsons Solicitors in Scotland handled the car accident claim of a home care worker who was hit by a third party vehicle during the course of her work.

The background
On the day of the road traffic accident in May 2019, our client and a colleague had been travelling in a work vehicle to visit a service user. Our client was driving at the time of the incident.
The collision occurred at 9.10am as our client's vehicle was proceeding east on the A72, Lanark Road, through Galashiels. A third party vehicle pulled out from a side road without stopping and drove into the side of her vehicle.
The van suffered significant damage to the driver's side door and full side panel. The police attended the scene of the accident and our client went to hospital.
The consequences
Our client suffered whiplash. She was diagnosed with soft tissue injuries lasting 12 months to her neck, lower back, right foot and ankle. Following the car accident, she needed to have physiotherapy and the incident triggered an escalation in her symptoms of depression.
The home carer was off work for several months and lost a significant amount of overtime payment as a result.
The settlement
The third party driver admitted liability at the scene and liability was also admitted by the defender.
A settlement was agreed prior to litigation and our client received car accident compensation in the sum of £7,050. The settlement was agreed on 3 February 2021.
