Skiing Accidents
Skiing is a common sport in Scotland and there are several popular ski slopes in the UK. However, it is a high risk sport and accidents do happen, some of which result in very serious personal injuries.
If you have been involved in a skiing accident which was not your fault, you may be able to bring a compensation claim against the person or company who was at fault.
Types of skiing accident you can claim for
Types of accidents which could result in an accident compensation claim are:
- Faulty Equipment – if there is a problem with the equipment, and this causes you to have an accident then you may be able to bring a compensation claim against the ski centre.
- Inadequate Skiing Tuition – if you have been given poor tuition by an instructor – for example, if the level of tuition was beyond your capabilities or your instructor took you to a slope that was too difficult - and this caused you to have an accident, you may be able to bring a compensation claim against your instructor.
- Lift Accidents – if the lift is not properly maintained or is faulty and this causes you to have an injury, you may be able to bring a compensation claim against the skiing centre.
- Other Skiers – if another skier is skiing dangerously and crashes into you causing an accident you may be able to claim against them.

Claiming for a ski accident abroad
If you are from Scotland and have suffered ski accident injuries in an incident in an EU country, there are a number of ways you may be able to claim compensation for your injuries.
For example, if you have suffered injury or illness during a winter sports package holiday abroad, you may be able to secure compensation from the tour operator concerned. The Package Travel and Linked Travel Arrangements Regulations 2018 can help you bring a claim against the package provider at any point within three years from the date on which the accident or illness occurred.
If the package operator is based in the UK, you should pursue your claim in Scotland. However, in some rare cases, it may be advisable to claim against a defendant who is based abroad.
