BMW diesel claim in Scotland
The ‘Dieselgate’ scandal began with Volkswagen Group in 2015, when it was discovered that VW was using software that could change the level of nitrogen oxide in a vehicle’s emissions during testing. It wasn’t long before the whole automobile industry was under scrutiny, and investigators suspected that many other manufacturers, including BMW, were using the software.
In 2018, German authorities raided BMW’s headquarters in Munich and Austria after they discovered that several models were emitting far higher levels of nitrogen oxide than what was recorded in laboratory tests. The company admitted to ‘mistakenly’ allocating the software to some of their diesel models and recalled 11,700 diesel cars. At the time of the recall, BMW released a statement: “The BMW Group realised that a correctly developed software module had been allocated in error to models for which it was not suited.”
It then promised to update the recalled vehicles with corrected software “as soon as it has been approved by the relevant authorities." About Germany’s emissions cartel
The recall was not BMW’s first emissions-related controversy. In 2017, the European Commission accused Germany’s three largest car manufacturers – BMW, Mercedes-Benz (formerly Daimler), and Volkswagen – of forming a cartel and colluding to limit the development of emissions technology that would have reduced the amount of pollution and made the cars cleaner and safer. These accusations of collusion led to the European Commission fining BMW €373 million ($442 million) and Volkswagen €502 million ($595 million) in 2021.
Daimler did not receive a fine because it had alerted authorities to the existence of the cartel. Margrethe Vestager, the European Union’s competition commissioner, said, “For over five years, the car manufacturers deliberately avoided to compete on cleaning better than what was required by E.U. emission standards. And they did it despite the relevant technology being available.”
