Power of Attorney for others
Obtaining a POA for a parent or relative
Many people turn to Thompsons to create a Power of Attorney for a parent or relative to ensure everything is in place if they become unable to deal with their own affairs in the future.
Our private client solicitors will arrange an appointment to meet with your parent or relative, as it will be them granting the powers. We need to confirm your parent or relative are fully competent and our instruction is coming from them and not from anyone else. During our meeting we will explain everything clearly ensuring they are fully aware of what they are putting in place. We will answer any questions you or your family members may have.
If you are coming along to the meeting please do not be insulted if we ask you to leave the room briefly or wait in reception whilst we take instructions from your family member.
Creating a POA for a child
In Scotland when a child turns 16 they become an adult, therefore as a parent you will lose the authority to act on your child’s behalf. This can be a worrying time for you as a parent if your child suffers from an illness or disability that will make it difficult for them to look after their own welfare and finances in the future.
Our solicitors will talk you through what can be put in place to protect your child in advance ensuring their interests are protected prior to turning 16. We will explain the differences between creating a power of attorney and guardianship order and the benefits of having this in place.
Our solicitors have a particular interest in the law with regards to these circumstances and put communication at the forefront of everything we do, an ability to communicate with families is essential in this area and we will ensure that everyone involved is confident in placing their trust in Thompsons.
