Fashion outlet TK Maxx has paid out compensation to a shopper who was injured while shopping in the chain’s Craigleith store in Edinburgh.
52 year old Anita Meena was looking at clothes when she was struck from behind by a suitcase which had been knocked from a display by another customer. The suitcase had been displayed on a shelf around five feet in height when it fell, landing on her shoulder and neck.
The accident exacerbated a pre existing condition from which Mrs Meena suffered which caused pain to her neck and shoulders. Liability was admitted immediately by TK Maxx for the accident in their store and Mrs Meena was awarded £2,000 for her injuries.
As a member of her union Unison, Mrs Meena was entitled to legal support from trade union lawyers Thompsons to pursue the claim. Thompsons Partner Patrick McGuire said: “It can be fairly daunting for individuals to challenge such a large and well known retailer but our client had a strong case as a victim of an accident which wasn’t her fault and we are extremely satisfied with the outcome.” Unison’s Head of Bargaining and Campaigns Dave Watson added: “UNISON members enjoy a range of valuable benefits and we are pleased that Mrs Meena received such a quick response and settlement.”
