Road Traffic Accident Claim Secures £110,000 for Seriously Injured Passenger
A woman who suffered multiple serious injuries in a head-on road traffic accident received £110,000 in compensation. Thompsons Solicitors Scotland pursued the claim after she was referred by her union, UNISON, following the collision with a third-party vehicle.
What happened
The accident occurred in August 2016 as the claimant was travelling home in a car driven by her husband.
As they approached a bend in the road, the weather conditions began to deteriorate and it started to rain while daylight was fading.
While navigating the bend, their vehicle was struck head-on by another car. The third-party driver had previously been living in France and was mistakenly driving on the wrong side of the road.
Police and emergency services attended the scene, and both the claimant and her husband were taken to hospital by ambulance.
Injuries and Impact
The collision caused the claimant to suffer internal abdominal injuries and an injury to her pelvis.
She also experienced ongoing pain in her left thigh and elbow and developed post-traumatic stress disorder (PTSD) following the incident.
Her injuries required a four-day stay in hospital and resulted in a considerable period away from work during her recovery.
Outcome
The third-party driver admitted liability at the scene of the collision, and police brought criminal charges of dangerous driving against him.
Thompsons’ specialist solicitors for motor accidents pursued a personal injury claim on the claimant’s behalf.
Following litigation, the defender accepted Thompsons’ offer and Thompsons secured £110,000 compensation for the claimant. Settlement of the serious injury claim was agreed on 22 September 2020.
