At Thompson’s we would like to reassure all our clients that as far as possible we are operating as normal. The health and safety of our staff and clients is our primary concern during this outbreak and as such we are reviewing the situation on a regular basis and will be adapting our working practices following government guidelines. However, we have had to make some minor changes to how we are doing things.

Following Government guidelines, we have temporarily closed all of our offices and our staff are now all working from home using secure technologies to ensure they are able to continue to progress with existing and new cases as normal. All face to face meetings have been cancelled, however we are continuing to hold these meetings via phone and video calls.  SCOTTISH PiP VICTIMS:  WE HAVE THE RIGHT TO MORE THAN A REFUND FOR THIS NIGHTMARE

The campaign group “PiP Implants Scotland” have sent a clear message to the clinics that they have the right to more than a refund for the nightmare they’ve been through. 

Patrick McGuire, PartnerThe comments come following yesterday night’s BBC Watchdog report into the scandal which suggested victims who paid for their surgery on credit cards had a case to be refunded under Section 75 of the Consumer Credit Act 1974.  The campaign group welcomed the report but made clear their view that they have the right to more than a refund.  

According to their lawyer and partner at Thompsons Solicitors, Patrick McGuire, the victims’ rights extend way beyond a refund for the initial operation and women could miss out on thousands in compensation if they fail to pursue damages for pain and suffering caused by the scandal. Spokeswoman for the PiP Implants Scotland campaign group, Trisha Devine, said:    “This development is welcome, but if the clinics think that we’re going to stop at a simple refund for the original operation they have another thing coming.  Our rights for justice go beyond a refund.

“This scandal has caused a lot of pain and suffering for women affected and there’s also the lost earnings because women have to take time off to get removal and replacement operations.

“I know there will be a lot of women who bought these operations on credit card who want this to be over as soon as possible – we all want that– but we can’t stop at a refund.  We must not let the clinics get away with how they’ve treated us.

“Some of the clinics have reacted well, but others have charged us for replacement operations and even asked us to sign away our legal rights in return for treatment.  They must not be allowed to get away with this. 

“The campaign for fair treatment and justice will continue.”

“This development is good news for the campaign and reinforces what we’ve said all along; that these implants should be classed as faulty goods.  However, it’s essential for those affected to remember that they are entitled to so much more than just a refund for their initial operation.

“The refund for the initial operation is only one part of the legal jigsaw.  If someone was to be refunded for their initial operation through their credit card they would also have the right to claim compensation for costs like scans, any lost earnings due to the removal or replacement operation as well as pain and suffering caused by the scandal.

“It is important that women do not miss out on the thousands in compensation, on top of a refund, that they could be owed for what they’ve been through because of this scandal.
