Solicitor in the employment team. Jillian's role involves providing a comprehensive employment law service to trades union members, including advice and representation for all aspects of Employment Tribunal, Employment Appeal Tribunal and Civil Court proceedings. In addition, she is regularly instructed to defend professionals against misconduct/lack of competence charges before their professional regulator (NMC, HCPC, SSSC etc).
As a labour and trades union activist Jillian is passionate about fighting for justice for ordinary working people. Working at Thompsons allows Jillian to combine her legal skills with her campaigning and public policy experience.
She particularly enjoys campaigning, influencing policy, and raising awareness of issues affecting workers. Recently, Jillian assisted the "Better than Zero" Campaign against zero hours contracts and sought to influence political decision makers over Employment Tribunal fees and reform. Jillian also writes on employment issues for a range of publications and blogs.
Jillian prides herself on her ability to build excellent relationships with clients. She believes that this gives people confidence in her approach and creates a relationship of trust. She gives legal advice in a clear, straightforward manner and deals with matters pragmatically.
Jillian completed her traineeship with Thompsons, specialising in employment law. Prior to working at Thompsons she volunteered at the Legal Services Agency assisting with cases for women and children who were victims of gender-based violence and commercial sexual exploitation. She has also worked at the Scottish Government, in the Office of the Solicitor to the Advocate General, assisting with devolution issues raised prior to the Supreme Court decision in Cadder, and providing support in cases, such as Axa v the Scottish Ministers.
During a gap year from University Jillian worked in the Scottish Parliament as a researcher for Jackie Baillie MSP. During this time she played a key role in taking the Disabled Persons' Parking Places (Scotland) Act 2009 through the Parliament as a Member's Bill. She also worked with the families affected by Clostridium Difficile, in order to provide full support to the C-Diff Justice Group in their successful campaign for a Public Inquiry into the deaths at The Vale of Leven Hospital.
Jillian is a former Chair of Scottish Labour Students.
Jillian currently deals with a mixed caseload of employment and professional disciplinary cases. She is particularly interested in the representation of women who have suffered widespread discrimination in the workplace.
As a result of receiving regular instructions regarding applications made by Regulators to prevent professionals practising their profession, Jillian has experience of interim interdict applications at the Court of Session. She has conducted a wide variety of proofs, preliminary hearings and debates before the Employment Tribunal and regulatory bodies. She has also recently acted in a Fatal Accident Inquiry at Glasgow Sheriff Court.
Jillian also has experience of management and representation in relation to politically sensitive, multiple claimant cases and complex discrimination cases.
For example, she acted for a woman dismissed due to pregnancy. Through mediation, a written commitment was secured that the employer would review their policies in relation to pregnant women and provide training to all staff regarding maternity rights. It is hoped that this will assist in ensuring what happened to the client does not happen to other women in the future.
More recently, Jillian raised a challenge on behalf of more than 50 union members to pay protection calculations within the NHS. The outcome has resulted in changes to the method of calculating pay protection across the whole of the NHS; resulting in thousands of pounds being back paid to workers throughout Scotland.
Jillian was the instructing solicitor in the first ever challenge to an NMC Interim Order Review Extension Application at the Court of Session.
