Employment Law - Regulatory Hearings

What can start a Regulatory Hearing?

The Regulators’ role is to protect the public.  Consequently, anyone can raise a concern against a registered professional whether they are members of the public, your employer(s) or other registered professionals.

There is no time limit to when a case can be brought forward and the bodies can consider events which took place many years ago, even at a time when you were not registered.

The types of cases Regulators will consider are generally those that question whether your fitness to practice is “impaired” by:

  • misconduct (such as inappropriate behaviour, dishonesty or deliberate clinical failings);
  • a lack of competence (not having the necessary skills and knowledge);
  • a conviction or caution for a crime in the UK (or somewhere else for an offence that would be a crime if it was committed in the UK);
  • your physical or mental health;
  • a determination (a decision) made by another Regulator responsible for health or social care; or
  • being included on a barred list which prevents you working with vulnerable adults or children.
  • whether your entry to their Register was made fraudulently or incorrectly.

If you are required to respond to allegations of such misconduct through a Regulatory Hearing it is important that you contact a solicitor for legal assistance.  Our specialist employment lawyers will give you a free telephone consultation to discuss your case.  Contact us on 0800 0891331.
