In the recent English case of Richardson v Butcher an 8 year old child was successful in claiming compensation from the driver of a vehicle, which struck him when he ran from the pavement onto the road sustaining serious injuries.
The road traffic accident occurred in Northumberland, England when the child crossed the road from the drivers offside and stopped directly in the driver’s path.
Compensation was claimed from the driver for the injuries and losses sustained by the child as a result of the road traffic accident.
The crucial element of the case was why the driver had not seen the child for the period of at least two seconds when he ran from the pavement into her path?
After hearing, all of the evidence the Judge found that had the driver been concentrating on the road ahead she would have seen the child for at least 2 seconds before she did and therefore held that the driver failed to take reasonable care and negligently hit the 8 year old child.
