A road worker sought compensation after being diagnosed with vibration white finger, also known as hand arm vibration syndrome. The symptoms of this industrial disease are stiff fingers, numbness in the fingers, and the thumbs appearing white in the morning. These factors make it difficult for him to pick up small objects. In addition to this, the disease is also made worse by further use of vibrating tools, meaning that the 46 year-old was unable to continue in his field of work.
During his period of employment, he was never warned of any of the dangers involved in the use of vibrating tools. Many employers in this industry also use rotating work patterns in order to minimise the damage, but this did not happen here. Because of this, his employer was in breach of the Provisions of the Control of Vibration at Work Regulations 2005.
However, after beginning court proceedings , he accepted a £10,000 compensation settlement from his employer.
