Compensation Increased for Bus Crash Victim

A woman who was involved in a road traffic accident involving a double decker bus recently had her award of compensation for the losses and injuries she sustained increased by an appeal Judge.

Miss Osei-Antwi, was a pedestrian who was standing on a pavement when a double decker bus came round the corner, the rear of the bus mounted the pavement striking Miss Osei-Antwi causing her to sustain significant injuries to her left ankle.

A Judge at the City of London Country Court awarded Miss Osei-Antwi compensation for the injuries and losses she had experienced as a result of the road traffic accident. The Judge at the County Court reduced the amount of compensation Miss Osei-Antwi was awarded as he felt she was partly to blame for the road traffic accident. The Judge at the Court Court held that notwithstanding the fact that Miss Osei-Antwi was standing on the pavement she ought not to have stood so close to the road and ought to have kept a good look out for the bus.

Miss Osei-Antwi appealed the County Court Judges decision that she was partly to blame for the road traffic accident.

The appeal Judge disagreed with the County Court Judge and overruled the County Court Judges decision that Miss Osei-Antwi was in any way to blame for the road traffic accident.  Miss Osei-Antwi’s appeal was successful and the amount of compensation awarded was increased, the appeal Judge advised that she had kept a good look out for the bus and at the time of the road traffic accident she was standing on a pavement in an area where no vehicles are entitled to be.
