Thompsons are delighted to collectively represent the families at the upcoming Public Inquiry into the C-Diff deaths at the Vale of Leven hospital, Alexandria. Public Inquiries are a big part of our work and are often a vital stage which allows victims and their families to gain answers to questions that may have weighed on their minds for years.  We realise that answers come before compensation and that is why we aim to provide our clients with Answers first, Compensation second and lastly Closure. We fought hard for the investigation into C-Diff at the Vale of Leven to be extended into a national public inquiry.  Our decision was vindicated again this week when a report by the Healthcare Environment Inspectorate into cleanliness at Dundee’s Ninewells Hospital revealed there was room for improvement. An action plan has been introduced to review the role of the hospital’s infection control manager and management procedures. 5 people died as a direct result of C-Diff infection in Ninewells hospital between October and November last year.

Newcastle High Court has awarded a paralysed man £8.35 Million in compensation which is one of the highest ever personal injury compensation payments in the UK.  Lukasz Borowski, 27, received the compensation after being left paralysed from the neck down following a car crash in 2005.   

Mr. Borowski was a rear sear passenger in a car being driven by Rozell Sands, who was convicted of dangerous driving.  The catastrophic injury has changed the victim’s life forever and the compensation awarded reflects the cost of care he will require for the remainder of his life.

 

Clydeside Action on Asbestos, pleural plaques victims and Frank Maguire, our Senior Partner at Thompsons Solicitors all welcomed the news that the bid by insurers to block the Scottish Parliament’s new law confirming the right to compensation of victims of pleural plaques has been blocked. Frank said: “This judgement states categorically that the Scottish Parliament was perfectly within its rights to pass this law and that is tremendous news for pleural plaques sufferers. We have an Act of the Scottish Parliament that establishes pleural plaques victims right to compensation and overturns the infamous House of Lords judgement to the contrary. Those responsible should now abide by the law. Thompsons have almost 1,000 pleural plaques cases which have been in limbo while the insurance industry pursued this ill-fated legal action and I now call on them to stop obstructing justice and not to try and put any more barriers in the way of victims seeking compensation. It was also noted that many insurance companies not involved in the court action, as well as the Ministry of Defence and British Shipbuilders, have been holding back on settling pleural plaques cases. They also should now meet their obligations and pay up. Frank went on to say “The Westminster Government should now enact similar legislation for the rest of the UK. It is ironic that pleural plaques sufferers in Gordon Brown’s constituency which includes Rosyth will now be able to claim compensation, but other MOD workers outside Scotland will not.” Suffers often have some form of breathlessness, but the biggest strain is the worry of developing a fatal condition like mesothelioma which happens with frightening regularity. Claimants mainly come from shipyard workers who had to cut asbestos boards – many stating that their employers kept them doing it long after they knew of the dangers telling them to use small blades rather than a buzz saws and to keep dust to a minimum. Out of 150 joiners who worked at the Caledonian joiners only 35 are still alive. The others all dying well before they were 65, most of them from mesothelioma or lung cancer.” This is a great day for the victims and their families.  

  I help thousands of people with accident compensation claims every week and really have seen it all.  However, sometimes even I am surprised at how poorly health and safety in the workplace is enforced.  Last week for example, Inverurie firm International Paper (UK) Limited were fined £6000 for an accident in which one of their workers lost an arm. The accident happened when the man got his arm caught in machinery in January 2009.  Investigation revealed that the safety barrier provided was completely inadequate to offer protection for workers. The HSE called the accident a “Dickensian-Style event” which should not have happened in this day and age. The man’s compensation claim continues.  

One Saturday, whilst enjoying a game of football Mr Smith was subject to what can only be described as an horrific tackle.  This tackle was so bad it broke his leg in 2 places, ended his football season and bought an early end to his football career. He contacted Thompsons to seek help as he’d lost wages, incurred additional expenses in treatment and was terrified at what lay ahead in terms of earning power.  Thompsons assessed his case and negotiated with the insurers of Cambuslang Rangers to secure a  compensation settlement in the sum of £40,000 – enough to offer financial security in the short term and allow him to assess how he takes his life forward.

One of our recent clients was a keen cyclist, he was a firm believer in its health and environmental benefits – even though cycling on Edinburgh city roads can be scary at the best of times between rush hour traffic and buses.  One thing he couldn’t have anticipated was an unprotected sunken drain on the designated cycle path in the middle of Holyrood Park especially since he’d cycled this way to work every day for the past couple of years.
Last August, 8.30am concentrating on the traffic he hit the drain, was thrown across the road and, despite wearing a helmet, smashed his cheekbone.  Unable to chew properly and with lasting facial numbness, he contacted Thompsons to claim compensation.  Everyday life had changed, his confidence and enjoyment of cycling in the city had come to an end and all because of the carelessness and negligence of another party.  Thompsons helped this client win £5,750 in compensation for his accident.  It will never undo the physical trauma suffered, but this is an ever increasing problem in the city.  If you have been hurt in a similar cycling accident let us know, you never know your call may help put an end to such carelessness and help others avoid being afflicted by a similar accident.

Compensation claims have increased 3 fold this month, particularly from cyclists.  With more people opting to cycle to work in the rush hour the number of accidents on the roads involving bikes has been steadily increasing. 

Most serious cyclists are prepared with well fitting helmets and quality bicycles, but educating drivers is another story.  Roundabouts prove to be a paricularly dangerous environment for cyclists and how the City addresses these incidents and encourages people to cycle each day is difficult, but the incidents that have come to our attention most recently were almost fatalities which is worrying and these victims are going to need financial security over the next 12 if not 24 months before they are fit to work again.  For this cyclist there was a least a positive financial outcome after successfully winning compensation for an accident that was not their fault.
