Frank Maguire

Frank Maguire is a Senior Partner with Thompsons Scotland. He specialises in personal injury and health & safety law.

Frank has considerable experience in dealing with accidents and diseases throughout his career of 23 years covering all sectors of industry and types of injuries. He is also a Solicitor Advocate.

He has considerable expertise in industrial disease cases. He has established well tried and efficient systems and a high quality of service for clients. He is also responsible for managing strategic initiatives of Thompsons Scotland including a successful Contact Centre. He is the former President of the Society of Solicitor Advocates and also on the panel for the Law Society of Scotland for Solicitor Advocacy. He obtained Certificate of Advanced Solicitor Advocacy in 2003. He has also done tutor courses in Advocacy.

He has been heavily involved in the change in law in Scotland on fatal damages leading to the Damages (Scotland) Act 1993, instrumental in changing CRU recoupment leading to the Social Security (Recovery of Benefits) Act 1997, advising and campaigning on the Chester Street Liquidation leading to the ABI announcement for asbestos cases.

He was Solicitor Advocate in a leading case in Scotland for fatal damages McManus -v- Babcock Energy Limited 1999 SC 569 SLT. He was also Lead Solicitor Advocate in the Inner House case of Murray's Executrix -v- The Greenock Dockyard Company Limited 2004 SLT 346 and then Solicitor Advocate in the case of Cruickshank's Executrix -v-Fairfield Rowan [2005] CSHO 1.

He has conducted a Complaint to the European Commission on the UK Authority's breach of Community Law and failure to implement Health & Safety Directives leading to the concession by the UK Authority in removing the exclusion of risk assessment from civil proceedings and amending legislation. He has also assisted the Commission with a further Complaint in respect of the term "reasonably practicable" in UK Legislation as being contrary to Community Law. The UK is now currently before the European Court of Justice.

He conducted a Petition before the Justice Committee and gave evidence and made representations in the Scottish Parliament leading to revisal of civil court procedures in the Court of Session.

He is also the solicitor acting for the Haemophilia Society and the families of those who have died of Hepatitis C in a challenge to the Lord Advocate and Health Minister in respect of an Inquiry into deaths from Hepatitis C. He is also giving evidence and making representations on behalf of Hepatitis C sufferers to the Health & Community Care Committee of the Scottish Parliament.

He is also currently advising major Trade Unions and the STUC on Corporate Killing. He has also acted as Lead Solicitor Advocate for other firms in substantial personal injury cases.
