With less people choosing the traditional method of using a travel agent for booking and arranging a holiday then it can be more difficult to ascertain whether or not a holiday will be a Tour Package under the Act. Traditionally a tour package holiday consisted of a charter flight and a week or a fortnight's accommodation. Legally, a holiday should comprise at least one overnight stay and consists of a pre-arranged combination of elements, sold at an inclusive price. This is set out in the Tour Package Regulations 1992.

The Package Travel, Package Holidays and Package Tours Regulations 1992

Regulation 2(1) of the Tour Package Regulations:-

A package means the pre-arranged combination of at least 2 of the following components when sold or offered for sale at an inclusive price and when the service covers a period of more than 24 hours or includes overnight accommodation

transport
accommodation
other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package

If you have paid for the different components under separate accounts then it will still be held to be a package. Therefore even if it is not a one or two week fun package in the sun from Thomas Cook etc then it can still be a package. i.e If you have picked out your own accommodation and choice of flights and or excursion on the internet, then it will still be a package as long as you paid for it at the same time.

It should also be remembered that the holiday does not have to be abroad to fall under the Tour Package Regulations.
