We refer to us winning a landmark Judgement against the Lord Advocate and the Scottish Ministers. Click link to Hepatitis C story.
We also had been successful in convincing the Health Committee of the Scottish Parliament to call on the then Labour Minister to hold a Public Inquiry. He refused.
Nicola Sturgeon, the new Health Secretary after the election to the Scottish Parliament, announced there would be an Inquiry. We will be discussing matters with the Health Minister, especially the remit and form of the Inquiry. It will be an Inquiry under the Inquiries Act 2005.
The Minister will now also require to comply with the requirements of Article 2 of the European Convention of Human Rights and Fundamental Freedoms in accordance with Lord Mackay's judgement against the Lord Advocate and the Scottish Ministers.
The principles of of Lord Mackay's judgement are equally applicable in England and in Wales and we are currently taking steps to force an Inquiry from the Government in Westminster also.
